محاكمة أسرى الحرب في غوانتانامو من طرف الولايات المتحدة الأمريكية على ضوء اتفاقية جنيف الثالثة لعام 1949

Résumé: نتعرض في هذا البحث بالدراسة لموضوع غاية في الأهمية في حقل الدراسات القانونية يتعلق بحق أسرى غوانتانامو في محاكمة عادلة ومنصفة، نظرا لما يثيره من إشكاليات تتعلق أساسا بحقوق مجموعة من الأفراد اعتقلتهم الولايات المتحدة الأمريكية في معتقل"غوانتانامو"الشهير، بتهمة الانضمام إلى جماعات إرهابية تهدد أمنها القومي، وذلك من خلال عرض معايير المحاكمة العادلة على ضوء اتفاقية جنيف الثالثة لأسرى الحرب لعام1949والبروتوكول الإضافي لعام1977، وبيان مدى تقيد الولايات المتحدة الأمريكية بها أثناء محاكمتها لأسرى غوانتانامو أمام لجان عسكرية أمريكية. Abstract: In this study we will examine a very important subject in the field of legal studies concerning the right of Guantanamo detainees to a just and fair trial, because of the problems related to the rights of a group individuals detained by the United-States in the famous Guantanamo Bay, for involvement In terrorist groups threatens its national security, Through the presentation of fair trial standards in the light of the Third Geneva Convention on Prisoners of War of 1949 and the Additional Protocol of 1977, and the extent to which the united states of America complies with them during its trial of Guantanamo prisoners.
