Fair Trial Guarantees Between International And National Guarantees ضمانات المحاكمة العادلة بين الضمانات الدولية و الوطنية

Résumé: Abstract: Fair trial guarantees at the international level include several key elements, such as the right to defense, the right to a public trial, the right to an independent and impartial court, and the right of the accused to know the charges againstthem.The seguarantees emphasize the importance of following proper legal procedures and providing transparency, which contributes to achieving justice. The seguarantees are alsoconsidered effective tools to combat torture and cruel treatment, and to provide protection for civil and politicalrights. At the national level, fair trial guarantees in Algeria include a set of similar rights, such as the right to defense, the right to a fair and public trial, and the right to appealjudgments. These guarantees are essential to ensure justice, but there are issues related to their implementation, such as delays in judicial proceedings and insufficient legal resources. الملخص: تشمل ضمانات المحاكمة العادلة على المستوى الدولي عدة عناصر رئيسية، مثل حق الدفاع، وحق المحاكمة العلنية، وحق محكمة مستقلة ومحايدة، وحق المتهم في معرفة التهم الموجهة إليه. تؤكد هذه الضمانات على أهمية اتباع الإجراءات القانونية السليمة وتوفير الشفافية، مما يساهم في تحقيق العدالة. كما تعتبر هذه الضمانات أدوات فعالة لمكافحة التعذيب والمعاملة القاسية، وتوفير الحماية للحقوق المدنية والسياسية. على المستوى الوطني، تشمل ضمانات المحاكمة العادلة في الجزائر مجموعة من الحقوق المماثلة، مثل حق الدفاع، وحق المحاكمة العادلة والعَلنية، وحق استئناف الأحكام. تُعتبر هذه الضمانات ضرورية لضمان العدالة، ولكن هناك مشاكل تتعلق بتنفيذها، مثل التأخيرات في الإجراءات القضائية ونقص الموارد القانونية.
