Résumé: ملخّص: إن موضوع التعسف في استعمال الحقوق عموماً والحضانة بصفة خاصة من المواضيع المتجددة بتجدد أشكال التعسف وطرقه على الرغم من الجهود التشريعية المبذولة لحماية الطفل، من خلال تكريس نصوص قانونية منسجمة، تضمن حماية حقوق المحضون من الضياع من خلال تفضيل مصلحة المحضون والموازنة بين حقوق المطلقين ومنع التعسف الواقع بينهما من خلال تبيان ما لكل منهما من حقوق والتزامات مخولة له بمقتضى الشرع و القانون،حرصا على ضمان أفضل رعاية للمحضون. Abstract: The issue of arbitrariness in the use of rights in general and custody in particular is one of the renewed topics in the renewal and methods of abuse in spite of the legislative efforts to protect the child through the consecration of harmonized legal texts guaranteeing the protection of the rights of the child to loss by favoring the interests of the child and balancing the rights of the oppressors In order to ensure the best care for the children
