أحكام جريمة ترك مقر الأسرة في التشريع الجزائري

Résumé: لقد حرص المشرّع جاهدا على حماية الأسرة من أي اعتداء يمس أمنها واستقرارها وتماسكها، حيث تُعالج هذه الورقة البحثية أحد أخطر الجرائم التي تقع على نظام الأسرة، التي ان وجدت تُزعزع كيانها، وتُشتت شمل العائلة، ألا وهي جريمة ترك مقر الأسرة المنصوص عليها في المادة 330 في فقرتها الأولى من قانون العقوبات، التي تقوم بترك أحد الوالدين لمقر الأسرة وتخليه عن التزاماته العائلية الملقاة عليه دون سبب جدّي، ففي هاته الدراسة سأوضح المقصود منها وأركان قيامها والآثار التي تترتب عليها، والحماية القانونية التي أقرها المشرّع الجزائري حالة توافر أركان وشروط قيامها. Abstract: The legislator has been keen to protect the family from any attack that affects its security, stability and cohesion, as this research paper deals with one of the most serious crimes that fall on the family system, which, if any, destabilizes its entity and disperses the family, namely the crime of leaving the family house stipulated in Article 330 In its first paragraph of the Penal Code, which involves leaving one of the parents to the family residence and abandoning his family obligations imposed on him without a serious reason, in this study I will explain what is meant by it, the pillars of its establishment and the effects that follow from it, and the legal protection approved by the Algerian legislator if the pillars and conditions for its establishment are available.
