Résumé: ملخص: يتميز نظام التعويض عن الأضرار الجسمانية الناتجة عن حوادث المرور المنصوص عليه بموجب الأمر رقم 74-15 المؤرخ في 30 يناير 1974 ،المتعلق بإلزامية التامين على السيارات وبنظام التعويض عن الأضرار المعدل والمتمم بالقانون رقم 88-31 المؤرخ في 19 جوان 1985 ،بمجموعة من الخصائص جعلته يختلف عن التعويض المقرر في القواعد العامة من عدة نواحي،أهمها من حيث مقدار التعويض المحدد في القانون على أساس نسبة العجز التي تلحق بالمضرور ،في حين نجد أن تقدير التعويض في القواعد العامة يخضع للسلطة التقديرية للقاضي ،كما أن المشرع اعتمد على مبدأ المساواة في التعويض بالنسبة لحوادث المرور،وهذا المبدأ غير مطبق في القواعد العامة ،بالإضافة إلى وجود مبدأ التضامن في التعويض عن الأضرار الجسمانية الناتجة عن حوادث المرور الذي يؤدي إلى حلول شركة التأمين محل المسؤل عن الضرر في دفع التعويض ،وفي حالة الحادث المجهول فإن صندوق ضمان التعويضات هو من يتولى التعويض عن الضرر، هذا ما جعل نظام تعويض الاضرار الجسمانية الناتجة عن حوادث المرور ،ينفرد بقواعد خاصة في التعويض تختلف عن ما هو مقرر في القواعد العامة.
