Résumé: تتعدد أدوار الدولة حيث تشمل جميع المجالات، ونظرا لمحدودية قدرتها على تلبية احتياجات المواطنين ، لجأت إلى أساليب جديدة للنهوض بعجلة التنمية الاقتصادية هي الشراكة بين القطاع العام والقطاع الخاص من خلال التنازل عن بعض المهام المنوطة لها لصالح القطاع الخاص، وتعتبر الشراكة بين القطاع العام والخاص أداة الإدارة الحديثة في تسيير المرافق العمومية وإنجاز وتطوير البنية التحتية والمشاريع التنموية،ويعتبر عقد الامتياز الإداري أحد هذه الأساليب فه وأحد أهم الحلول العملية لمواجهة عدم قدرة الإدارة على تلبية احتياجات المواطنين -الركود الاقتصادي-،إلا أن ذلك لا يكتمل إلا بتوفير الإطار القانوني العام لعقود الشراكة لتوفير المناخ الاستثماري الأمثل. rôles of the state are varied in all areas because of its limited ability to meet the needs of citizens, ItHave resorted to new approaches to advancing economic developmentis a partnership between the public and the private sector,To waive some of the tasks entrusted to it in favor of the private sector ;Public-private partnerships are a tool for modern management of public utilities,And the completion and development of infrastructure and development projects,The management concession contract is one of the most important practical solutions,To cope with the inability of the administration to meet the needs of citizens economic recession,However, this is only accomplished by providing the general legal framework for partnership contracts .
