أثر الإعاقة على الرابطة الزوجية - دراسة على ضوء أحكام الفقه الإسلامي والتشريعات المعاصرة – The Impact Of Disability On The Marital Bond -a Study In The Light Of The Provisions Of Islamic Jurisprudence And Contemporary Legislation

Résumé: نبحث هنا قضية تأثير الإعاقة على نشوء الرابطة الزوجية أو انحلالها بالنسبة للجنسين، وقد اعتمدنا استقصاء مواقف فقهاء الشريعة الإسلامية والتشريعات القانونية التي عالجت المسألة، ومناقشة الآراء والأدلة والترجيح بينها، انتهاء إلى الرؤية المعاصرة والاتجاهات الحديثة . ومن أهم نتائج البحث أن الشريعة سمحت بفسخ العقد بالعيوب التي تجيز فسخ الزواج، والحاكم يتولى تنظيم المسألة ويحفظ الحقوق، أما القوانين فقد أجازت في أغلبها زواج ذوي الاحتياجات الخاصة بشروط دقيقة في إطار رضا الطرف الآخر وحفظ حقوقه We discuss here the issue of the impact of disability on the emergence of the marriage bond or its dissolution with respect to both sexes, and we have adopted a survey on the positions of jurists of Islamic law and legal legislations that dealt with the issue, and a discussion of opinions and evidence and the weighting between them, ending with contemporary view and modern trends. One of the most important research findings is that Sharia law allowed the dissolution of the contract with flaws that allow the dissolution of the marriage, and the sovereign settles the matter and preserves the rights. As for the laws, most allow marriage for people with special needs under specific conditions within the framework of the consent of the other party and preserving their rights.
