أثر الاتفاقيات الدولية المتعلقة بحقوق الإنسان على التشريعات الوطنية (قانون الأسرة نموذجا)

Résumé: ملخص: إن المواءمة بين قواعد القانون الدولي المعنية بحماية الأسرة وقواعد القانون الداخلي تتطلب إعمال وإنفاذ قواعد القانون الدولي في نظام القانون الداخلي، حيث ينص الدستور عادة على القيمة القانونية للمعاهدات الدولية في النظام القانوني الداخلي، إذ أن الاتفاقيات الدولية المصادق عليها تسمو على القانون. وبالتالي، فإن هناك تأثيرات مباشرة للاتفاقيات الدولية المتعلقة بشؤون الأسرة على التشريع الداخلي، وعليه، فقد تم تعديل قانون الأسرة الجزائري من خلال الأمر رقم 05/02 المؤرخ في: 27/02/2005، ليكون متواكبا مع الكثير من بنود تلك الاتفاقيات الدولية. Abstract: The harmonization between the rules of international law concerned with family protection and the rules of domestic law requires the implementation and enforcement of the rules of international law in the system of domestic law, as the constitution usually stipulates the legal value of international treaties in the domestic legal system, as ratified international agreements transcend the law. Thus, there are direct effects of international agreements related to family affairs on domestic legislation, and accordingly, the Algerian Family Code was amended through Order No. 05/02 of 02/27/2005, to be in line with many of the provisions of those international agreements.
