الاتفاقيات الدولية مصدر لقانون الأسرة: بين المحافظة على خصوصيات المجتمع والوفاء بالالتزامات الدولية

Résumé: تعتبر الاتفاقيات الدولية، خاصة تلك المتعلقة بحقوق الإنسان مصدرا ماديا لقانون الأسرة، لان هذا الأخير بعض أحكامه مستمدة منها، خاصة اتفاقية CEDAW بعد تعديله بالامر05-02، كما تعتبر مصدرا رسميا عندما تتعارض أحكام قانون الأسرة مع أحكام الاتفاقيات الدولية المصادق عليها، فتستبعد الأحكام الأولى وتطبق الأحكام الأخيرة (أحكام الاتفاقيات الدولية) طبقا للمادة 154من الدستور، وبذلك تصبح جزءا من القانون الداخلي ، ومن ثم فللأشخاص والمؤسسات حق التمسك بتطبيقها، وعلى القضاة الالتزام بها وعدم مخالفتها طبقا لأحكام المادة 171 من الدستور والمادة 358/7 من قانون الإجراءات المدنية والإدارية، وإلا أصبحت أحكامه عرضة للطعن بالنقض. الكلمات المفتاحية: الاتفاقيات الدولية، سيداو، قانون الأسرة، الالتزامات الدولية Abstract: International conventions, especially those relating to human rights, are a material source of family law, because the latter has some of its provisions derived from it, especially the CEDAW agreement after it has been amended by order 05-02, and is an official source when the provisions of the family law conflict with the provisions of international conventions ratified, excluding the first provisions and applying the last provisions (provisions of international conventions) in accordance with article 1. 154 Of the Constitution, thus it becomes part of the internal law, so people and institutions have the right to uphold their application, and judges must abide by them and not violate them in accordance with the provisions of article 171 of the Constitution and article 358/7 of the Civil and Administrative Procedure Act, otherwise its provisions are subject to appeal.
