التحقيق في المسائل التي خالف فيها الأندلسيون قول مالك في المدونة

Résumé: ملخَّص المقال بالعربية : تتمحور هذه الدراسة حول التحقيق في المسائل التي خالف فيها الأندلسيون قول مالك رحمه الله في المدونة ، ذلك لأن قوله فيها مما شُهِّر بعد ذلك وعليه اعتمد مصنفو الفتيا والقضاء؛ لأنه مما يجري وفق أصوله وقواعده، وليس من السهل مخالفة المالكي لمالك، لذلك جاءت هذه الدراسة للتحقيق فيما نُسب لأهل الأندلس مخالفتهم له، والهدف من ذلك بيان حقيقة هذه المخالفات ببيان قائليها وذكر مستندهم في المخالفة، واستنباط أسباب الخلاف، وذلك من خلال اتباع المنهج الاستقرائي لنقول المؤلفين في كتبهم عن أهل الأندلس في هذه المسائل ، وكذا المنهج التحليلي وذلك بالتنقيح والتحليل والتوجيه لِمَا نُقل في ذلك وصولا إلى بيان المسألة. مخلص المقال بالانجليزية : Investigate the issues in which the Andalusians disagreed with Malik's statement in the Code Prof: Hamza Bounaas Prince Abdul Qader University of Islamic Sciences Constantine Abstract This study focuses on the investigation of the issues in which the Andalusians disagreed with the statement of Malik (may Allaah have mercy on him) in the Code, because he said it in a month after that. Hence, he adopted the fatwas of the fatwas and the judiciary, because this is according to its rules and rules. The purpose of this statement is to explain the truth of these irregularities by making a statement to them and stating their document in the violation, and devising the reasons for the dispute. This is done by following the inductive method to tell the authors in their books about the people of Andalusia in these matters, To guide what transfer it down to the statement of the matter.
