مستجدات رقمنة الصفقات العمومية في ظل القانون رقم 23-12 المحدد للقواعد العامة المتعلقة بالصفقات العمومية

Résumé: تهدف الرقمنة عموما الى تكريس الشفافية، مكافحة الفساد وتحقيق النزاهة في التعاملات بين الإدارة والمواطن في إطار التحول إلى الإدارة الالكترونية ، تميز القانون 23-12 المحدد للقواعد العامة المتعلقة بالصفقات العمومية بتكريسه الصريح للرقمنة في الصفقات العمومية بما يتوافق و تحقيق مبادئ الصفقات العمومية، يحقق بذلك انتقال رقمي ونوعي مستندا في ذلك على آليات جسدها في إطار اعلامي ،رقابي واحصائي وعملياتي منها، اللجوء الى تشجيع المؤسسات الناشئة الحاملة للعلامة المتخصصة في الرقمنة والإبتكار ، اتضح أن القانون 23-12 اعتمد على أسس في المجال التكنولوجي و أبرزها بشكل أكثر وضوحا غير أنه يبقى القانون لا تكتمل فاعليته إلا بصدور النصوص التنظيمية التي تدعم ما أشار اليه القانون . Digitalisation generally aims to establish transparency, combat corruption and achieve integrity in the transactions between the administration and the citizens as part of the transformation towards electronic administration, Law 23-12 defining the general rules related to public procurement was characterised by expressing a clear definition of digitalisation in public procurement in accordance with the principles of public procurement, achieving a digital and qualitative transition based on mechanisms based on an informative, monitoring, statistical and operational framework, including resorting to the encouragement of emerging institutions specialised in digitalisation and creativity, as well as the promotion of brand-bearing start-ups in digitalisation and creativity , It is understood that Law 23-12 relies on technological bases and makes it clearer, but the law remains effective only after the issuance of the regulatory texts that support what the law refers to.
