Résumé: في إطار تفعيل الرقابة على الصفقات العمومية، نظرا لارتباطها بالمال العام، وبالاقتصاد الوطني، تم النص لأول مرة على إنشاء المجلس الوطني للصفقات العمومية بموجب القانون الجديد 23-12 المحدد للقواعد العامة المتعلقة بالصفقات العمومية؛ بمهام يغلب عليها الطابع الاستشاري، وبعض المهام ذات الطابع الرقابي، وصلاحية الاقتراح المحددة في مجال معين، وقد عَوَضَ المجلس الوطني للصفقات العمومية، سلطة ضبط الصفقات العمومية وتفويضات المرفق العام؛ المنصوص عليها سابقا بموجب المرسوم الرئاسي 15-247. وتعتبر البوابة الالكترونية للصفقات العمومية من أهم التطبيقات التي استحدثت لتدعيم الإدارة الالكترونية، ورقمنة مجال الصفقات العمومية بما تتيح من خدمات إلكترونية للمصلحة المتعاقدة والمتعاملين الاقتصادين وجميع المهتمين، وقد عرف التأكيد على وجوب العمل بهذه البوابة التدرج بين الاختيار؛ ثم الإلزامية في النظام القانوني للصفقات العمومية؛ والتي كرسها القانون 23-12. To activate oversight of public procurement due to its connection to public funds and the national economy, it was stipulated for the first time to establish the National Council for Public Procurement under the new Law 23-12 specifying the general rules related to public procurement. It was granted tasks of a predominantly advisory nature, some tasks of a supervisory nature, and specific proposal authority in a specific field. The National Council for Public Procurement was replaced by the authority to control public procurement and public utility mandates. Previously provided for under Presidential Decree 15-247. The electronic portal for public procurement is considered one of the most important applications that have been developed to strengthen electronic administration and digitize the field of public procurement. Because it provides electronic services to the contracting authority, economic clients, and all those interested, it was confirmed that it was activated voluntarily at the beginning, then it was mandatory in Law 23-12.
