النظام القانوني لعقد البيع الدولي للبضائع المبرم عبر شبكة الأنترنت

Résumé: الملخص: كان للتطورات التكنولوجية الحالية، دور في ظهور مفاهيم وأنظمة قانونية دولية جديدة، في مختلف المجالات، وكان لهذه التطورات أثر بارز في عقود التجارة الدولية، والذي يعد عقد البيع الدولي للبضائع أهمها نظرا لشيوعه، وهذا ما جعل الجهود تسير في مواءمة مختلف النصوص الداخلية والدولية للأحكام التي اقتضتها تلك التطورات، وهذا ما يجعل مسألة أو عملية التعاقد عبر شبكة الانترنت في عقود البيوع الدولية للبضائع من المفاهيم المستحدثة، التي يجب أن توليها التشريعات الداخلية، - بما فيها التشريع الجزائري - أهمية وعناية خاصة، حتى تضبط معالمها وتؤمنها من المخاطر التقنية، بما يتماشى والخصوصية الاجتماعية، الاقتصادية، والسياسية لكل دولة. Abstract: The current technological developments have played a role in the emergence of new international legal concepts and systems in various fields. These developments have had significant impacts on international trade contracts, the most important of which is the international sale of goods contract due to its prevalence. This has made efforts going to harmonize the various internal and international texts of the provisions required by these developments; which makes the issue or the process of online contracting in the international sales of goods contracts a new concept; that internal legislations - including the Algerian legislation- must give a special importance and attention, in order to adjust its features and secure it from technical risks, in line with social, economic, and political specificity of each country.
