الحماية القانونية للمعالم التاريخية

Résumé: إن التراث الثقافي هو الخط المستقيم بين حاضر الشعوب وماضيهم رغم الاختلاف بينهم، والمعالم التاريخية احد ابرز أوجه الممتلكات الثقافية التي تميز كل بلد عن الآخر ، فهي تمثل الهوية الوطنية، لما لها من قيمة حضرية، ثقافية، فنية، اجتماعية واقتصادية، بحيث تتجسد فيها أنماط تفكير الشعوب ومستوى تفكيرهم الراقي، مما جعلها عرضة للاعتداءات والمخاطر المختلفة التي باتت تهدد أصولها الضاربة في التاريخ، هذا الأمر الذي أصبح يتطلب الحفاظ عليها، وحمايتها من خلال ما وفرته الجزائر على غرار بقية دول العالم من هيئات وطنية وأخرى محلية، ولا ننسى الآليات التي خص بها المشرع الجزائري المعالم التاريخية، التي كان الهدف الأساسي منها توفير الحماية القانونية اللازمة لها. الكلمات المفتاحية: التراث الثقافي،المعالم التاريخية،الحماية القانونية Abstract : The cultural heritage is the straight line between the present of peoples and their past despite the differences between them, and the historical landmarks are one of the most prominent aspects of cultural properties that distinguish each country from the other, as they represent the national identity, due to its civilizational, cultural, artistic, social, and economic value, embodying the thought patterns of peoples and the level of their refined thinking, which has made them vulnerable to various attacks and risks that threaten their historical roots, a matter that requires preservation and protection through what Algeria, like the rest of the world, has provided in terms of national and local bodies, not to mention the mechanisms provided by Algerian legislation for historical landmarks, the main objective of which was to provide the necessary legal protection for them.
