Kتصنيف الجرائم الجمركية في التشريع الجمركي الجزائري

Résumé: تحرص اغلب الدول ومن بينها الجزائر على تكييف منظوماتها القانونية الداخلية وكذا مؤسساتها ، بما يتماشى مع نتائج النظام العالمي الجديد على المستوى الاقتصادي من خلال توجيه تلك الأنظمة والمؤسسات بما يخدم أكثر السياسة الحمائية للاقتصاديات الداخلية من كل الأفعال غير مشروعة وكذا ظاهرة الجريمة المنظمة التي يشهدها العالم ككل والجزائر على الخصوص باعتبارها منطقة عبور، ويعتبر جهاز الجمارك من الأجهزة أوكلت لها مهمة تنظيم ومراقبة مبادلات التجارة الخارجية بالإضافة إلى بعض الأدوار التقليدية الأخرى وذلك انطلاقا من النصوص القانونية والتنظيمية المتضمنة في التشريع الجمركي، وتحاول هده الورقة البحثية دراسة مسألة تصنيف الجرائم الجمركية لمعرفة إلى أي مدى كان المشرع موفقا في تصنيفه لتلك الجرائم المتضمنة في قانون الجمارك مع ما تتطلبه خصوصية تلك الجرائم وفي ظل احترام القواعد العامة المعمول بها في المجال الجنائي *** Abstract: Most countries, including Algeria, are keen to adapt their internal legal systems as well as their institutions, in line with the results of the new world order at the economic level, by directing these systems and institutions to serve the most protectionist policy for internal economies from all illegal acts, as well as the phenomenon of organized crime that the world as a whole is witnessing.
