النشوز في قانون الأسرة الجزائري

Résumé: لقد حدد فقهاء الشريعة تعريفا للنشوز، فعرفه المالكية بأنه خروج الزوجة عن طاعة زوجها، وبينوا طرق علاجه، في حين لم يبين المشرع الجزائري في قانون الأسرة الجزائري مفهوم الزوجة أو الزوج الناشز، بل اكتفي بذكر أثار النشوز واعتباره سبب من أسباب فك الرابطة الزوجية. وقد ذكر في نص المادة 222 بأنه: كل ما لم يرد النص عليه في هذا القانون يرجع فيه إلى أحكام الشريعة الإسلامية". ونص القرآن الكريم على أن النشوز محرم على كلا الزوجين بالكتاب والسنة، لهذا قمنا بدراسة عدة جوانب مهمة لهذا البحث في الشريعة الإسلامية والقانون الأسرة الجزائري، وذلك من خلال فصلين، تناولنا في الفصل الأول: تعريف النشوز وحكمه، والأفعال التي تعد بها الزوجة ناشزا. والفصل الثاني تطرقنا إلى آثار النشوز وطرق ووسائل معالجة نشوز في الشريعة الإسلامية وقانون الأسرة الجزائري. Sharia scholars defined the starch, and the Malikis defined it as the wife's departure from obedience to her husband, and explained the ways of treating him, while the Algerian legislator in Algerian family law did not explain the concept of a wife or husband who was a publisher, but merely mentioned the effects of the starches and considered it one of the reasons for the dismantling of the marital bond. In the text of article 222, he stated that: "All that is not provided for in this law is due to the provisions of Islamic law." The Qur'an stipulated that the starch is forbidden for both spouses in the Book and sunnah, That is why we have studied several important aspects of this research in Islamic law and Algerian family law, through two chapters, which we dealt with in chapter 1: the definition and judgment of the nachos, and the acts of wife Nashza. The second chapter touched on the effects of ecstasy and ways and means of addressing the rise of Islamic law and Algerian family law.
