أساس الضرر الموجب للتعويض في مجال المسؤولية المدنية للدولة، ودور القاضي الإداري في تقدير التعويض الخاص به

Résumé: الملخص: تخضع أغلبية المرافق العمومية إلى قواعد المسؤولية الإدارية، وهذا متى تسببت الإدارة في إلحاق ضرر للغير بسبب قيامها بنشاطاتها المختلفة تلبية لحاجات الأفراد. ومن ثم، فمتى ثبت الضرر الناتج عن نشاطها، قامت مسؤوليتها أيا كان أساسها (الخطأ أو المخاطر). ومن هنا، فقد أقر كلا من التشريع والقضاء لهؤلاء الأفراد وحماية لحقوقهم الحق في اللجوء إلى القضاء الإداري للمطالبة بإصلاح الضرر الناتج عن عملها عن طريق الحق في التعويض. والذي لا يتم الفصل فيه إلا وفق قواعد ومبادئ كرسها التشريع والقضاء، ومنح فيها للقاضي الإداري السلطة التقديرية الواسعة للفصل فيه. abstract : The majority of public utilities are subject to administrative liability rules, and this is when the Department has caused damage to others by carrying out its various activities to meet the needs of individuals. Thus, once the damage caused by its activity has been established, it is liable regardless of its basis (fault or risk). Thus, both the legislation and the judiciary have granted these individuals and the protection of their rights, the right to resort to the administrative courts to demand that the damage caused by their work be repaired through the right to compensation. And it is decided only in accordance with rules and principles enshrined in the legislation and the judiciary, in which the administrative judge is given broad discretion to adjudicate.
