مبدأ الأمن القانوني ومدى تكريسه في القضاء الإداري

Résumé: يعتبر مبدأ الأمن القانوني من أهم المبادئ التي تقوم على أساسها دولة القانون، والذي يعني أن تكون المراكز القانونية واضحة وفعالة غير معرضة للاهتزاز والمفاجآت؛ فيستند في قيامه وتحقيقه على عدد من المبادئ القانونية التي لابد من الالتزام بها في ظل أي مجتمع قائم على حكم القاعدة القانونية، كالعلم بالقاعدة القانونية وإتاحة إمكانية الوصول إليها والالتزام الخاص الذي يترتب على الدولة. ومما هو جدير ذكره هو أن القضاء يعتبر عنصرا حاسما في حل المنازعات وهو جزء أساسي من فكرة الأمن القانوني، فلا يمكن أن ننفي تكريس هذا المبدأ في القضاء خاصة القضاء الإداري، وذلك من خلال عرض جملة من القضايا التي فصل فيها مجلس الدولة والتي تعتبر كصورة حقيقية لتكريس مبدأ الأمن القانوني كإلغاء قرار صادر عن سلطة إدارية لمساسه بالحقوق المكتسبة. Abstract: The principle of legal security is one of the most important principles on which the state of law is based, this means that the legal status are clear and effective, it is based on a number of legal principles that must be adhered to in any society based on the rule of law.
