أثر الاضراب على سير المرفق العام

Résumé: تناولت هذه الدراسة أثر الاضراب على سير المرفق العام˓ هادفة الى بيان ماهيته واثاره القانونية وقد تم الوقوف على مفهومه˓ وعناصره˓ وأشكاله˓ وشروط اللجوء اليه˓ وأثاره على علاقة العمل وعلى الهيئة المستخدمة على حد سواء . فتبين أن الحق في الإضراب حق أصيل و مكفول، في المواثيق و العهود الدولية، كما هو الحال في الوثائق الدستورية الجزائرية˓ كما تبين أيضا أن للاضراب اثار متعددة على سير المرفق العام منها مايمس الادارة من خلال التأثير على مبدا استمراية المرافق العامة ومنها ما يؤثر على الموظف العام باعتباره أحد عناصر المرفق العام .ولذلك اورد المشرع الجزائري جملة من القيود على ممارسة حق الإضراب لضمان المصلحة العامة . الكلمات المفتاحية: الاضراب˓ شروط اللجوء الى الاضراب˓ أثر الاضراب. Abstract This study examines the Impact of the strike on the functioning of public services˓ aiming to clarify its nature and legal effects Its concept˓ elements˓ forms˓ conditions for resorting to it and its effects on the work relationship and on the employing body have been examined equally• It turns out that the right of strike is original right guaranteed in international covenants˓ as is the case in Algerian constitutional documents• It was also found that the strike has multiple effects on the functioning of the public services˓ some of which affect the administration by affecting the principle of the continuity of public services˓ and some of them affect the public employee as one of the elements of the public services• therefore˓ the Algerian legislator has listed a number of restrictions on the practice of the right of strike to ensure the public interest• Key words: Strike˓ Conditions of recourse to strike˓ Damage effect
