التزام المتدخل بسلامة المواد الغذائية وأمن المنتوجات

Résumé: الملخص أقر المشرع الجزائري مبدأ الالتزام بالسلامة، ويظهر ذلك من خلال إلتزام المتدخل بسلامة وأمن المنتوجات، وهذا لحماية صحة وسلامة المستهلك باعتباره طرفا ضعيفا في العلاقة الاستهلاكية. إن هذا الالتزام بالسلامة الذي انتقل في نشأته من الإجتهاد القضائي إلى التكريس التشريعي من خلال عقد النقل وتشريعات حماية المستهلك، والعمل والفندقة والسياحة، هذا الواجب العام بالسلامة آثار إشكالات قانونية وفقهية حول طبيعته بين الالتزام ببذل عناية والتزام بتحقيق نتيجة وبين كونه التزام عقدي أم قانوني، وكل هذه المسائل القانونية المتعلقة بالالتزام بالسلامة نظرا للاهتمام الدولي المتزايد بحقوق الإنسان ومنها الحق في حرمة جسم الإنسان نظرا للانتشار الرهيب للمواد الغذائية، والتعديلات الجينية لهذه المواد الاستهلاكية التي ستنعكس على صحة وسلامة الإنسان. الكلمات المفتاحية:الالتزام بالسلامة، المتدخل، المستهلك، المادة الغذائية، المنتوج Abstract The Algerian legislator has adopted the principle of the obligation to safety, and this is demonstrated through obligation the interventionist to the safety and security of the products, this is to protect the health and safety of the consumer as a weak party in ther consumer relationship. This commitment to safety, which evolved from jurisprudence to legislative enshrinement through the contract of carriage and consumer protection legislation and work, hotel and tourism, this general duty to safety the effects of legal and doctrinal problems about its nature between the obligation to take care and the obligation to achieve a result and the fact that it is a legal contractual obligation. Human rights, and all these legal issues relating to the obligation to safety in view of the growing international concern for human rights, including the right to inviolability of the human body owing to the terrible proliferation of foodstuffs, genetic modifications of these consumables that will reflect on human health and safety.
