Résumé: الملخص: اختطاف الأشخاص جريمة شديدة الخطورة لأنها تؤدي إلى إبعاد الشخص عن مأمنه باستخدام وسائل ‏قسرية أو غير قسرية من أجل تحقيق منفعة أو خدمة ذات طبيعة إجرامية ، مما دفع المشرع الجزائري إلى إصدار ‏القانون رقم 20-15 المتعلق بالوقاية من جرائم اختطاف الأشخاص ومكافحتها، والذي حاول إحداث التوزان بين ‏الشق الموضوعي والجوانب الإجرائية، حيث استحدث إجراء التسرب الإكتروني لإحباط مخططات اختطاف الأشخاص ‏قبل حدوثها، وضبط والقبض على المجرمين متى وقعت هذه الجريمة فعلا، ما يجعله إجراء وقائيا، وفي الوقت نفسه ‏آلية يمكن من خلالها تدعيم ملف الإدانة، ولكن يجب أن يتم وفق ضوابط دستورية وقانونية خاصة حتى لا يمس ‏بالخصوصية الرقمية للأشخاص. ‏ Abstract: The kidnapping of persons is a very dangerous crime because it leads to the ‎removal of a person from his safety by using coercive or non-coercive means in order to ‎achieve a benefit or service of a criminal nature, which prompted the Algerian legislator ‎to issue Law No. 15-20 on the prevention and control of kidnapping crimes, Which tried ‎to create a balance between the substantive part and the procedural aspects, as he ‎introduced the electronic leakage procedure to thwart plans to kidnap people before ‎they happen, and to control and arrest criminals when this crime actually occurred, ‎which makes it a preventive measure, and at the same time a mechanism through which ‎the conviction file can be strengthened However, it must be done according to special ‎constitutional and legal controls so as not to compromise people's digital privacy.‎
