Résumé: بالنظر للآثار السلبية المترتبة على تطبيق قانون الصفقات العمومية على ارض الواقع ، تم الشروع في إعداد مشروع نص قانوني في صوره مدونة أخلاقيات خاصة بالصفقات العمومية من قبل سلطة ضبط الصفقات وتفويضات المرفق العام ووزارة المالية ، تعمل على تحديد حقوق وواجبات الأعوان العموميين من خلال إبرام وتنفيذ الصفقات العمومية ، كما أن هذه المدونة الأخلاقية تعمل على حماية أكثر لمصداقية الصفقة العمومية والإدارة في مجال إبرام العقود الإدارية وغلق كل منافذ الفساد والرشوة واستغلال النفوذ والحصول على امتيازات. Abstract: In view of the negative effects of the application of the Public Procurement Law on the ground, a draft legal text has been initiated in the form of a code of ethics for public deals by the procurement control authority and the authorizations of the public utility and the Ministry of Finance, working to define the rights and duties of public agents through the conclusion and implementation of deals Moreover, this ethical code works to further protect the credibility of the public deal and management in the field of concluding administrative contracts and closing all outlets for corruption, bribery, abuse of influence and obtaining privileges.
