مدونة أخلاقيات المهنة كآلية وقائية من الفساد في الصفقات العمومية وفق القانون 23/12

Résumé: تهدف هذه الدراسة لمعالجة إشكالية مدى تفعيل مدونة أخلاقيات المهنة الخاصة بالأعوان العموميين المتدخلين في الصفقات العمومية كآلية للوقاية من الفساد في الصفقات العمومية وفق القانون 23/12، نظرا لما للإلتزام الأخلاقي من أثر إيجابي في الوقاية من الفساد وحماية المال العام . توصلت الدراسة إلى أنه بالرغم من تكريس هذه المدونة في الإتفاقيات الدولية لمكافحة الفساد المصادق عليها من طرف الجزائر و القوانين الداخلية التي كان آخرها القانون 23/12 المتعلق بالقواعد العامة للصفقات العمومية الجديد، إلا أن هذه المدونة لم تجسد على أرض الواقع، و عليه يتوجب الإسراع في تجسيدها و تفعيلها للحد من الفساد في الصفقات العمومية. Abstract: This study aims to address the issue of the extent to which the Code of Ethics for public officials involved in public procurement transactions is implemented as a mechanism for preventing corruption in public procurement, in accordance with Law 23/12, given the positive impact of ethical commitment on corruption prevention and the protection of public funds. The study has concluded that despite the incorporation of this code into international anti-corruption agreements ratified by Algeria and domestic laws, the latest being Law 23/12 concerning the general rules for public procurement, this code has not been effectively implemented in practice. Therefore, there is a need to expedite its implementation and activation to reduce corruption in public procurement
