إثبات الخطا الطبي الموجب للمسؤولية المدنية Proof Of Medical Error Requiring Civil Liability

Résumé: الملخص إثبات الخطأ الطبي ليس بالأمر الهين بالنسبة للمريض حتى يتمكن من الحصول على التعويض، ويوزع عبء إثباته مابين المريض والطبيب ، ومع ذلك يشترط فيه أن يكون محقق ، متميز وثابتا ، بغض النظر عن ما إذا كان عادي أو فني ، جسيم أو يسير، إلا أن معايير تمييزه حددت بالمعيار الشخصي والمعيار الموضوعي وبعد نقدهما ظهر المعيار المختلط المتعلق بالفعل غير المألوف . أما عبء إثباته فهو موزع ما بين المريض والطبيب بحسب طبيعة التزام هذا الأخير، ويثبت إما بالملف الطبي والشهادات الطبية ، التي لها حجية المحررات العرفية ، أو بالخبرة الطبية التي هي غير ملزمة للقاضي. Proving medical error is not easy for the patient to get compensation, the burden of proof is distributed between the patient and the doctor, yet it is required to be distinct and stable, regardless of whether it is normal or technical, serious or easy, but the criteria for its discrimination are defined by the personal standard and the objective criterion and after their criticism the mixed standard related to the unusual act appeared. As for the burden of proof, it is distributed between the patient and the doctor according to the nature of the latter's commitment, and it is proven either by the medical file and medical certificates that have the authenticity of the customary papers, or by medical expertise that is not binding on the judge.
