النظام العقابي المستحدث لتطبيق المسؤولية الجزائية على لشخص المعنوي

Résumé: إن المسؤولية الجزائية باعتبارها مسؤولية قانونية يقصد بها ثبوت الجريمة إلى الشخص الذي أرتكب فعلا غير مشروع يصبح بمقتضاه مستحقا للعقوبة التي قررها القانون ،وإذا كان محل المساءلة الجزائية منذ قدم هو الإنسان " الشخص الطبيعي" فإن قيام جماعة الأفراد إلى جانب هذا الأخير لتحقيق ما يعجز عنه بمفرده خدمة له ولغيره، جعلها ذات كيان مميز عن كيان الأفراد الذي تتكون منه، إذ أنها لم تغن بغناء أحدهم وظهرت بالتالي فكرة الشخصية المعنوية أو الاعتبارية التي أفرزت عدة نظريات قانونية بعضها اعتبرها شخصية افتراضية، والبعض الآخر حقيقة، و الاتجاه الثالث جعل منها تقنية قانونية، لينتهي الأمر إلى الاعتراف بالشخص المعنوي كطرف للحق متمتع بالشخصية القانونية.
