Résumé: يهدف هذا البحث الموسوم بـ »تزوير المحررات الإلكترونية بين قابلية الخضوع للقواعد التقليدية وضرورة مراعاة الخصوصية« إلى إبراز مدى إسباغ المشرع الجنائي الجزائري الحماية على المحررات الإلكترونية ضد جرائم التزوير، في ظل إحجامه عن تحديث التشريع العقابي ليتلاءم مع التطور التكنولوجي والخصوصية التي تتمتع بها المحررات الحديثة. وقد تم ذلك في صورة جدلية من خلال ثلاثة محاور، تتعلق بكل من الركن الشرعي والمحل في جريمة تزوير المحررات الإلكترونية، إضافة إلى الركن المادي لهذه الجريمة، خاصة ما تعلق منه بطرق التزوير المادية والمعنوية وركن الضرر، إضافة إلى الركن المعنوي. وقد خلصنا إلى ضرورة تحديث التشريع العقابي الجزائري ليتلاءم مع خصوصية جريمة تزوير المحررات الإلكترونية رغم إمكانية تطبيق القواعد التقليدية عليها، ولو على وجه من الصعوبة والتعقيد. Abstract : This research's title has been came «Counterfeiting Electronic documents between a portability the subjection to traditional rules and need to be observed for the privacy» aims to highlight how the algerian legislator protected an electronic documents against counterfeit crimes, under of his abstention for developing a punitive legislation to fit with technological progress and privacy of modern documents . This study has been discussed the topic in three axes, related to the legal corner, the evidence of the electronic documents counterfeit crime, in addition, its physical corner, specially, what is attached to a ways of physical and mental counterfeit, and damage corner, mental corner as well. The study concluded that it must develop the Algerian punitive legislation to fit with the electronic documents counterfeit crime, even without applying a traditional rules, in difficult and complex conditions.
