Résumé: يعتبر المستشفى العمومي الجهاز الوحيد الذي تقوم الدولة من خلاله بتقديم الخدمات الصحية للأفراد ، يضطلع بنوعين من النشاط : النشاط الإداري و التنظيمي ، و الذي يتمثل في كيفية الإدارة و التسيير و كذا الصيانة في المستشفى العام . و النشاط الطبي العلاجي ، و الذي يتمثل في ما يقوم به الأطباء و الممرضين الموظفين في المستشفى (الطاقم البشري) ؛ يخضع الموظفين في المستشفى العمومي للعديد من الالتزامات الواجبة الإتباع و بالأخص الأطباء ، حيث يترتب على الإخلال بها قيام المسؤولية ،و هذه المسؤولية تتنوع عل حسب درجة جسامة الخطأ ، فيمكن أن تكون مسؤولية شخصية للطبيب إذا كان الخطأ شخصيا بحتا ، كما يمكن أن يتحمّلها المستشفى العمومي إذا ما ارتبط الخطأ بالوظيفة . بالإضافة إلى ذلك يمكن أن تقوم مسؤولية المستشفى العمومي بدون خطأ على أساس المخاطر إلا أن هذا يكون في حالات محددة و استثنائية .. و يترتب على قيام المسؤولية على المستشفى العمومي آثار وهي قيام المسؤولية الإدارية ضد المستشفى العمومي والتي ينتج عنها دعوى التعويض التي يرفعها المريض المضرور من نشاطات المستشفى ، يختص القاضي الإداري بالنظر و الفصل في دعوى التعويض معتمدا في تقديره لهذا الأخير المبادئ الأساسية واجبة المراعاة ، مع ما له من سلطة تقديرية واسعة في كل مراحل هاته الدعوى .
