قانون 14/04 المتعلق بالنشاط السمعي البصري في الجزائر: بين متغيرات المرحلة وضرورات التعديل

Résumé: لا يزال القانون رقم 14/04 المتعلق بالنشاط السمعي البصري يثير النقاش حول مضمونه وضرورات تعديله، حاولنا في هذه الدراسة الوصول إلى مجموعة من الأهداف، أهمها: تنبيه المشرع إلى ضرورة تغيير هذا القانون الذي مر عليه أكثر من ثمانية سنوات ولا يزال ساري المفعول دون جدوى عملية منه، وكذلك تقديم مقترحات عملية لتنظيم قطاع السمعي البصري لمزيد من الاحترافية القائمة على حرية التعبير وحقوق الصحفيين، وبعد الدراسة والبحث توصلنا لأهم النتائج وفي مقدمتها: تعديل هذا القانون بما يتماشى والتغيرات التي تعرفها البلاد، وضرورة تشريع قانون جديد يوسع هامش الحريات ويعطي ضمانات أكبر لاستقلالية المؤسسات الإعلامية. الكلمات المفتاحية: حرية الرأي والتعبير. التشريعات الإعلامية. الاعلام السمعي البصري. الاشهار. قانون 14/04. Abstract: The audiovisual activity 04/14 Law in Algeria continues to raise debate about its content and the necessity of amending it. The current study aims to achieve a set of goals .One most important goal is alert the legislator to the necessity of changing this law, which has been in practice for more than eight years without being useful. The study also aims at presenting practical suggestions to organize the audiovisual sector for more professionalism that is based on Freedom of expression and rights of journalists. The study revealed interesting results: Amendment of this law in accordance with the changes taking place in the country and finally the necessity of enacting a new law that expands the margin of freedoms and gives greater guarantees for the independence of media institutions.
