المسؤولية الدولية عن الأضرار النووية وقت السلم

Résumé: الملخص: لا يختلف اثنان على أن استخدام الطاقة النووية لأغراض سلمية أمر جد ممتاز ومشروع بترخيص العديد من الإتفاقيات الدولية، شريطة أن تلتزم الدولة المالكة والجهة المستخدمة باستغلال هذه الطاقة لما سخرت لها سلميا دون تعريض الغير للضرر، مع الإلتزام بوجوب اتخاذ كافة التدابير الرامية إلى توفير هذه الحماية، وفي حال ما إذا ترتب عن هذا الإستخدام السلمي إلحاق أضرار بالغير تجد هذه الدولة نفسها أمام إلزامية تحمل المسؤولية الدولية في حقها، من خلال تحمل مختلف تبعات نشاطها النووي، وذلك وفقا لإتفاقيات دولية تؤسس عليها هذه المسؤولية المدنية وكذا المطلقة، التي تلزم الدولة بدفع تعويض للطرف المتضرر نوويا، مع الإقرار بتحملها لتبعات هذا النشاط النووي حتى وإن ترتب هذا الأخير دون صدور أي خطأ من الدولة المالكة أو المستخدمة. Abstract: There is no dispute that the use of nuclear energy for peaceful purposes is a very excellent and common matter with the licensing of many international conventions, provided that the owner state and the party using this energy are committed to exploiting this energy for what they have been rocked for peacefully without exposing others to harm, with the obligation to take all measures aimed at providing this protection And in the event that this peaceful use results in harm to others, this country finds itself obligated to bear international responsibility against it, by bearing the various consequences of its nuclear activity, in accordance with international agreements on which this civil as well as absolute responsibility is based, which obliges the state to pay compensation For the nuclear-affected party, while acknowledging that it bears the consequences of this nuclear activity, even if the latter was caused without any fault on the part of the owner or user state.
