الحقوق السيادية للدولة الساحلية وفق إتفاقية 1982 (المنطقة الإقتصادية الخالصة نموذجا)

Résumé: أبرمت إتفاقية الأمم المتحدة لقانون البحار لسنة 1982 بعد المطالبات الكثيرة من الدول الساحلية في إستغلال الموارد التي تحتويها البيئة البحرية، كونها تعتبر مصدرا للثروات وبالتالي تساعد على تحقيق التنمية، وحتى تقوم كل دولة بالإنتفاع بالثروات البحرية في حدود إقليمها البحري دون أن تنتهك حدود دولة أخرى نصت هذه الإتفاقية على عدة مناطق بحرية وحددت كيفية قياسها وكذا حقوق وإلتزامات كل دولة فيها، وبإستقراء نصوص الإتفاقية نجد أن هناك مناطق تمارس فيها الدولة الساحلية سيادة مطلقة ومناطق أخرى تمارس فيها حقوق سيادية فقط، ومن بينها المنطقة الإقتصادية الخالصة. وتتمثل إشكالية هذه الدراسة في: فيما يتمثل النظام القانوني للمنطقة الإقتصادية الخالصة حسب إتفاقية 1982؟ وأهم النتائج المتوصل إليها هي أن المنطقة الإقتصادية الخالصة من المناطق التي لا تخضع للسيادة المطلقة للدولة الساحلية ، فهي تمارس فيها حقوق سيادية فقط. The 1982 United Nations Convention on the Law of the Sea was concluded following numerous claims by coastal States to exploit the resources contained in the marine environment as a source of wealth, thus helping to achieve development, and in order for each State to benefit from marine wealth within its maritime territory without violating another State's borders, this Convention stipulates several maritime zones and defines how to measure them, as well as the rights and obligations of each State therein. With the extrapolation of the Convention's texts, there are areas where the coastal State exercises absolute sovereignty and other areas where sovereign rights are exercised only, including the exclusive economic zone. The problem with this study is: what is the legal regime of the exclusive economic zone in accordance with the 1982 Convention? The most important finding is that the exclusive economic zone of areas not subject to the absolute sovereignty of the coastal State, in which it only exercises sovereign rights.
