محافظة الدولة هيكل للقضاء الاداري بمهمة النيابة العامة

Résumé: الهدف من هذا المقال الوقوف على مدى ملائمة المصطلح الذي عبر به المشرع على اختصاصات هذه الهيئة مقارنة بما سارت عليه الأنظمة المقارنة، والتي تؤكد عدم فهم المشرع الجزائري لدورها بحكم تأثره بجهاز النيابة العامة على مستوى القضاء العادي، إذ باسقاط مهام النيابة العامة على وظيفة محافظة الدولة نتيقن أن المشرع الجزائري لم يفهم دور ها واسند لها مهمة مقزمة لا تعبر عن حقيقة دورها مما يستدعي اعادة النظر فيها. The aim of this article was to determine the appropriateness of the term by which the legislator expressed the competencies of this body compared to what was compared to the comparative systems, which confirm the Algerian legislator’s lack of understanding of its role by virtue of being affected by the Public Prosecution Service at the regular judiciary level, as by dropping the functions of the Public Prosecution on a conservative job The state is certain that the Algerian legislator did not understand her role and was assigned a dwarfing mission that does not reflect the reality of her role, which necessitates a review.
