تكريس مبدأ حرية المنافسة في مجال إبرام الصفقات العمومية في ظل المرسوم الرئاسي رقم 15-247

Résumé: تهدف هذه الدراسة إلى البحث في مدى تكريس مبدأ حرية المنافسة عند إبرام الصفقات العمومية في ضوء المرسوم الرئاسي رقم 15-247 المتضمن تنظيم الصفقات العمومية وتفويضات المرفق العام، وتوصلنا فيها إلى أن هذا المبدأ يتجسد في إجراء طلب العروض، ويضيق مجاله في إجراء التراضي بعد الاستشارة، في حين ينتفي في إجراء التراضي البسيط. كما أن المصلحة المتعاقدة والمتعامل الاقتصادي ملزمين باحترام مبدأ المنافسة في جميع مراحل إبرام الصفقة العمومية، غير أن الواقع أثبت وجود ممارسات منافية للمنافسة الشريفة. This study aims to examine to what extent the principale of freedom of competition is enshrined in the conclusion of public markets according to the Presidential Decree No. 15-247, which includes the regulation of public markets and the delegation of public services.in this study we found that this principale occurs clearly in the calls for tenders and is restricted and disappeared, in the simple agreement it disappeared totally, however, it’s restricted in cases of agreement after consultation . The contracting authority and the economic operator are required to respect the principle of competition at all stages of the conclusion of a public market, but reality has proved the existence of practices contrary to fair competition
