الإطار القانوني الجديد المنظم للنشاط الإعلامي ودوره في تكريس حرية الإعلام بالجزائر

Résumé: تعتبر حرية الإعلام من أهم دعائم تحقيق الإنتقال الديمقراطي وبناء دولة القانون، بعد التعديل الدستوري لسنة 2020 وبهدف تكريس ودعم حرية الإعلام في الجزائر، قام المشرع الجزائري بمراجعة الإطار القانوني المنظم للنشاط الإعلامي، حيث صدر القانون العضوي المتعلق بالإعلام والقانون المتعلق بالصحافة المكتوبة والصحافة الالكترونية والقانون المتعلق بالنشاط السمعي البصري خلال سنة 2023، من خلال هذا البحث قمنا بدراسة النصوص الجديدة ومقارنتها بالنصوص السابقة المتمثلة في القانون العضوي للإعلام لسنة 2012 والقانون المتعلق بالسمعي البصري لسنة 2014 بهدف معرفة دورها في تكريس ودعم حرية الإعلام، حيث خلصنا في الأخير إلى وجود مجموعة من الأحكام الجديدة التي تعزز حرية الإعلام، في المقابل لاحظنا وجود بعض النقائص قمنا بالإشارة إليها من أجل تداركها مستقبلا عند تعديل هذه النصوص. Media freedom is considered one of the most important pillars for achieving democratic transition and building a State of law, after the constitutional amendment of 2020 and in order to establish and support media freedom in Algeria, the Algerian legislator reviewed the legal framework governing media activities, The organic law related to the media, the law related to the written press and electronic journalism, and the law related to audiovisual activity were issued during the year 2023, Through this research we studied the new texts and compared them with the previous texts namely the Organic Media Law of 2012 and the Law Related to Audiovisuals of 2014, with the aim of understanding their role in consecrating and supporting media freedom, In the end we concluded that there are a set of new provisions that enhance media freedom, On the other hand we noticed some shortcomings that we pointed out in order to correct them in the future when amending these texts.
