Résumé: ملخص إن الرقابة العادية لقاضي الإلغاء على السلطة التقديرية للإدارة والتي يستعمل فيها أساليب تقليدية، والمتمثلة في مراقبة الوجود المادي و القانوني للوقائع، و صحة التكييف السليم لها، و مراقبة التناسب، غير كافية للحد من تعسف الإدارة في مواجهة الحقوق و الحريات العامة ، لأنها لا تواجه الميادين الحديثة التي تتدخل فيها الإدارة والتي تتمتع فيها بسلطة تقديرية. مما دفع قضاء الإلغاء إلى خلق أساليب حديثة في الرقابة على السلطة التقديرية للإدارة، وذلك بالسماح لقاضي الإلغاء بالتضييق عليها بمراقبة ركن السبب بالاعتماد على نظرية الخطأ الفادح أو الواضح في التقدير ، و بمراقبة ركن المحل بالاستناد إلى نظرية التوازن بين المنافع و الأضرار. لقد أخذ قضاء الإلغاء في الجزائر بهذه الأساليب الحديثة في نطاق ضيق ومحدود في مجال الوظيفة العامة و نزع الملكية من أجل المنفعة العامة ، في انتظار مسايرة هذا التطور وذلك بتوسيع تطبيقها في كل الميادين الحديثة كالاستثمار و الأعمال و البيئة و العمران. Abstract In fact ,the traditional methods used by the nullification magistrate in monitoring the discretionary power of the administration , and which appear in the form of controlling the legal and material existence of facts, the validity of the qualification and the monitoring of proportionality, prove to be insufficient to restrict the abuse of the administration which affect the rights and collective liberties ,and this is due to the fact that this ordinary monitoring doesn‘t face the new areas where the administration interfere making use of its discretionary power . The methods have been adopted by the nullification judiciary in Algeria , but in a marrow scope in the area of civil service and expropriation for public utility .these methods have to be extended to all the new areas such as ;investment ,business, environment, town planning .
