الأحكام الموضوعية والإجرائية لاستصدار رخصة البناء المتعلقة بتشييد المساجد The Substantive And Procedural Provisions For Issuing A Building Permit Related To The Construction Of Mosques

Résumé: الملخص: أخضع المشرع الجزائري العقارات المُخَصصة لصالح الشؤون الدينية والأوقاف بغية إنشاء المساجد لاستصدار رخصة بناءٍ، وهو ما أشارت إليه عموم قوانين البناء والتعمير كالقانون رقم: 82-02، والمرسوم التنفيذي رقم: 19-15، وأكدته أحكام المرسوم التنفيذي رقم: 13-377، المتضمن القانون الأساسي للمسجد. وقد تطرقت الدراسة للتعريف برخصة البناء وذكر خصائصها، والوثائق الواجب إدراجها حسب الحالة والجهة المودعة على مستواها، كما تطرقت الدراسة إلى المخططات العمرانية سواء المخطط التوجیهي للتهیئة والتعمیر، أو مخطط شغل الأراضي، مع التأكيد على الإلتزامات الواجبة الإتباع على طالب رخصة البناء بعد تسلمها؛ والتي تعد في عمومها من الشروط الشكلية والموضوعية لبناء المساجد. Abstract: The Algerian legislator subjected the real estate allocated for the benefit of religious affairs and endowments to the necessity of obtaining a permit for the construction of mosques, which is indicated by all building and reconstruction laws such as Law No. 02: 82 and Executive Decree No. 15-19, and confirmed by the provisions of Executive Decree No. 13-377, which contains Basic Law of the Mosque. The study dealt with the definition of the building permit and its characteristics, the documents that must be included according to the situation and the authority to which it is deposited. The study also addressed the urban plans, whether the master plan for preparation and reconstruction or the land occupation scheme, with an emphasis on the obligations that must be followed by the building permit applicant after receiving it, which are generally considered formal and objective conditions for building mosques.
