تحويل حق الانتفاع الدائم إلى حق امتياز للحائزين على الأراضي الفلاحية التابعة للدولة بطريقة غير قانونية

Résumé: أفرزت عملية تحويل حق الانتفاع الدائم إلى حق امتياز طبقا للقانون رقم 10/03 عدة وضعيات لأشخاص يستغلون العقار الفلاحي التابع للملكية الخاصة للدولة بطريقة غير قانونية ،و بناء على الملفات المقدمة من قبلهم فإن الأمر يتعلق بالأشخاص الذين يحوزون على عقود تنازل موثقة غير مشهرة أو عقود عرفية و غيرها من الأوضاع غير القانونية التي حالت دون تحويل حق الانتفاع الدائم إلى حق امتياز في الآجال القانونية المقررة في القانون رقم 10/03. و قد عالج المشرع العديد من هذه الوضعيات بموجب اجراءات التنظيم الداخلي The process of converting the permanent usufruct into a concession right according to Law No. 03/10 resulted in several situations of people who illegally exploit the agricultural property of the state's private property, and based on the files submitted by them, the matter is related to people who have notarized notarized assignment contracts or contracts Martial law and other illegal conditions that prevented the permanent usufruct from being converted into a privileged right within the legal deadlines stipulated in Law No. 03/10. The legislator has dealt with many of these situations according to the procedures of internal organization
