الارتفاقات الادارية في مجال البريد والاتصالات الالكترونية وفقا للقانون الجزائري

Résumé: تعتبر أملاك البريد والاتصالات الالكترونية أملاك عمومية بموجب الدستور الجزائري لسنة 2020 لاسيما المادة 20 منه، إلا أن هذه الأملاك لها علاقة بالملكيات المجاورة، وذلك بموجب الارتفاقات التي قررها القانون العام، وهي قيود على الأملاك الخاصة تسعى لتحقيق المصلحة العامة من جهة، وحماية الأملاك العمومية من جهة أخرى، كما وردت هذه الارتفاقات بنصوص خاصة متعلقة بقواعد شغل الأملاك العمومية والخاصة، والاستفادة من الارتفاقات المرتبطة بانتشار شبكات الاتصالات الإلكترونية التي جاء بها القانون رقم 18-04 يتعلق بالبريد والاتصالات الالكترونية، الأمر الذي يؤدي بنا إلى التساؤل عن خصوصية هذه الارتفاقات، وما هي مستجداتها في ظل التطورات التقنية والتكنولوجية المسجلة في هذا القطاع. According to the Algerian Constitution of 2020, especially in its article 20, “Mail and electronic communications' assets are considered as public property, however, these properties have a connection with "Neighboring Properties", and that according to the easements established by the common law, and they are restrictions on private property that target the public interest on the one hand, and protect Public properties on the other hand. These easements have been provided with special legal provisions related to the rules for occupying public and private properties, and benefiting from the easements related to the spread of electronic communication networks that came in law 18-04 related to mail and electronic communications. Based on the above, we inquire about the specificities of these easements and their updates, in light of the technical and technological developments recorded in this sector.
