نظرية العقد في الفقه الإسلامي الدلالة والأثر

Résumé: This research dealt with a basic theory that gives the researcher a juristic queen that qualifies his idea and helps him to understand the concepts of jurisprudence, which is "the theory of the contract in Islamic jurisprudence". Contemporary researchers in the theories and the terms and conditions they contain, then the research concluded with the effects of the correct contract and not others, because the contract is either true or incorrect, and each contract has general and other special effects. تناول هذا البحث نظرية أساسية تعطي الباحث ملكة فقهية تؤهل فكره وتعينه على مدارك الفقه، وهي "نظرية العقد في الفقه الإسلامي"، كما تطرق للحديث عن المسائل العامة المتعلقة بالنظرية من خلال مفهومها، والفرق بينها وبين القاعدة الفقهية وخلاف العلماء فيها، وتتبعت في ذلك منهج الباحثين المعاصرين في النظريات وما تتضمنه من شروط وأركان، ثم ختم البحث بآثار العقد الصحيح دون غيره، ذلك أن العقد إما أن يكون صحيحا أو غير صحيح، وكل عقد له آثار عامة وأخرى خاصة.
