الجزاء الجنائي في قانون العقوبات الجزائري

Résumé: العقوبة الجنائية هي النتيجة القانونية التي تتبع السلوك بعد الجريمة، وتطبيقها هو النتيجة القانونية الناتجة عن مخالفة أحكام التجريم في قانون العقوبات. وتشمل أشكال العقوبة الجنائية العقوبات والتدابير الاحترازية. الغرض من العقوبات هو مكافحة الجرائم من خلال تهديد وردع كل من يرتكب جريمة ومحاسبته على أفعاله وفقا للقانون. وتتمثل في حرمان الجاني من بعض حقوقه الشخصية وأبرزها الحق في الحياة والحق في من أجل الحرية. أما الشكل الثاني للعقوبة فيتمثل في التدابير الاحترازية التي يجوز للمشرع أن يقررها كبديل للعقوبة. وفي بعض الأحيان، يصاحبون العقوبة نفسها. وترتبط الإجراءات الأمنية ارتباطاً وثيقاً بالخطر الإجرامي، ولا يمكن اتخاذها إلا بعد ثبوت هذا الخطر. وتتوقف عن الوجود بمجرد زوال الخطر.Criminal punishment is the legal consequence that follows a behaviour after a crime,and its application is the legal outcome resulting from the violation of the provisions of criminalization in the penal code. The formes of criminal punishment include penalties andprecautionary measures. The purpose of penalties is to combat crimes by threatening and deterring anyone who commits a crime holding them accountable for their actions according to the law .they consist of depriving the offender of some of their personal rights, most notably the right to life and the right to freedom. The second form of punishment is represented by precautionary measures, which the legislator may decide as an alternative to punishment. Sometimes, they accompany the penalty itself. Security measures are closely linked to the criminal danger and can only be taken when this danger is proven. They cease to exist once the danger is eliminated.
