استثمار وقف الملكية الفكرية_ حق المؤلف

Résumé: ملخص: تتطرق هذه الدراسة إلى إبراز مكانة وقف حق المؤلف المادي، ودور هذا النوع من المساهمات الوقفية وأثره على التنمية الاجتماعية والاقتصادية، بحيث تثار إشكالية فحواها تتمحور حول مكانة هذا النوع من الأوقاف في التشريع الاقتصادي الجزائري من خلال التطرق للنصوص القانونية الخاصة وذات الصلة بموضوعات الوقف، وحقوق المؤلف والحقوق المجاورة. وفي سبيل تحقيق أهداف الدراسة قسمنا العمل إلى محورين أساسين أولهما حقوق المؤلف المادية وصور وقفها، والمحور الثاني إلى استثمار حق المؤلف المادي الموقوف وآثاره، منتهجين الوصف والتحليل للوقوف على مختلف أبعاد الدراسة، وخلص هذا العمل إلى نتائج أهمها:أوقاف الملكية الفكرية في شقها المتعلق بحق المؤلف لها مردود اقتصادي مهم، لذلك فمسألة تنميتها بالاستثمار المشروع يحقق النماء والازدهــــــــــار على مستوى الصيرفة التشاركية، إلا أن أحكام قانون الأوقاف الجزائري لا تراعي خصوصية هذا النوع من الحقوق المقرونة بمدة محددة بعد وفاة المؤلف. Abstract: This study deals with highlighting the status of the suspension of copyright, the role of this type of endowment contributions and its impact on social and economic development, so that the content of its content revolves around the dimensions of this type of endowments in the Algerian economic legislation by raising the special legal texts related to the waqf, and rights Author and Neighboring Rights. In order to achieve the aims of the study, we divided the work into two main axes, taking the description and analysis to find out the various dimensions of the study, and this work concluded with the most important results: intellectual property endowments have an important economic return, so the issue of their development By legitimate investment, it achieves growth and prosperity at the level of participatory banking.
