المسؤولية المدنية للبنك عن عملية القرض الاستهلاكي

Résumé: عقد القرض الإستهلاكي يتم اللجوء إليه من قبل الأفراد نظرا للقدرة المالية المحدودة لسد الإحتياجات الشخصية والضرورية عن طريق إبرام العقد، وتقوم المسؤولية المدنية للبنك في حالة إخلال البنك بأحد الإلتزامات سواء التعاقدية أو التقصيرية، وذلك بإرتكاب خطأ من البنك يلحق الضرر بالعميل المقترض ووجود علاقة السببية تربط بينهما، حيث يلجأ المدعي المضرور برفع دعوى المسؤولية المدنية، والغرض منها المطالبة بإصلاح الضرر عن طريق التعويض وإرجاع المضرور إلى الحالة التي كان فيها، ويكون التعويض إما التعويض العيني أو التعويض بمقابل التعويض نقدي أو غير نقدي، ويقوم القاضي بتقدير التعويض عن طريق إصدار الحكم. الكلمات المفتاحية: القرض الإستهلاكي، المسؤولية المدنية للبنك، المسؤولية العقدية، المسؤولية التقصيرية.
