الأمر الجزائي "الإجراء المبسط للفصل في الدعوى العمومية دون محاكمة" The Penal Order “a Simplified Procedure For Separation Of Public Cases Without Trial”

Résumé: تكرّست إجراءات المتابعة الجزائية عن طريق الأمر الجزائي بناءا على تعديل قانون الإجراءات الجزائية رقم 15-02، فيعد متابعة جزائية دون الاعتماد على إجراءات المحاكمة العادية، كالمناقشة، العلنية والوجاهية، تلجأ إليه النيابة العامة كإجراء جوازي في الجرائم البسيطة وتحيل ملف المتابعة أمام قاضي الجنح للفصل فيه بأحكام قابلة للاعتراض، هدفها اختصار الوقت والتخفيف عن قضاة محاكم الجنح، جاء هذا الإجراء خصيصا لتخفيف العبء عن قضاة أقسام الجنح، ويعد من بين أهم الإجراءات المستحدثة ضمن سلسلة التعديلات التي مسّت قانون الإجراءات الجزائية. سنبين من خلال هذا الموضوع أهم مميزات هذا الإجراء سواء على المتقاضي أو القاضي، معرجا على أهم الانتقادات الموجهة له، لنخلص في الأخير مدى توافق المشرع الجزائري في احترام الموازنة بين اعتماد إجراءات بسيطة تخفف عبء القضاء واحترام الحقوق والضمانات المكرسة قانونا للمتهم لتحقيق محاكمة عادلة. Criminal follow-up procedures are enshrined by means of the criminal order, based on the amendment of the Criminal Procedure Law No. 15-02, It is considered a criminal follow-up without relying on regular trial procedures, such as discussion, public and face-to-face, It is used by the Public Prosecution as a legal measure for simplified crimes, And refer the follow-up file before a misdemeanor judge for a decision Objectionable provisions, Its to shorten time and relieve misdemeanor judges, This procedure came specifically to reduce the burden on misdemeanors judges, and is considered among the most important measures developed within the series of amendments that touched the law of criminal procedures. The last is the extent of the compatibility of the Algerian legislator in respecting the balance between adopting simple procedures that reduce the burden of the judiciary and respect for the rights and guarantees legally established for the accused to achieve a fair trial.
