ممارسة الحرية النقابية في الوظيفة العامة

Résumé: حضيت الحرية النقابية باهتمام دولي من خلال المعاهدات والمواثيق الدولية وتم تكريسه عندما أصدرت الجمعية العامة للأمم المتحدة عام 1947 قراراً يتضمن الاعتراف بحق النقابات، واكدت الاتفاقية رقم 87 لسنة 1948 على حماية مصالح العمال وحماية حق التنظيم وتتناول دراستنا ممارسة الحرية النقابية في الوظيفة العامة التي أكدت عليها وعلى حمايتها الاتفاقية رقم 154، كما تم النص عليها في عدة اتفاقيات وتوصيات دولية أخرى اما على المستوى الوطني فقد حضيت الحرية النقابية باهتمام المشرع الجزائري الذي أقر بممارسة الحرية النقابية طبقا لماء نصت عليه المعايير الدولية وتكريسه دستوريا وقانونيا ويتجلى من خلال القانون 23-02 المؤرخ في 25 ابريل 2023 المتعلق بممارسة الحق النقابي. إضافة الى قوانين اخرى ذات صلة بممارسة الحرية النقابية، ورغم هذا نجد معيقات للممارسة الحرية النقابية تقلص من الضمانات التي أقرها القانون لحماية الحرية النقابية في الوظيفة العامة. Through international treaties and conventions, the freedom of labor union was given international attention and was enshrined when the United Nations General Assembly adopted a resolution in 1947 recognizing the right of labor unions and affirming Convention No. 87 of 1948 concerning the protection of workers' interests and the right to organize. Our research focuses on the practice of free labor union in the public sector, which is confirmed and protected by Convention No. 154, as well as by a number of other international conventions and recommendations. The Algerian legislature has devoted attention to freedom of labor union at the national level, recognizing its practice in conformity with international standards and its constitutional and legal basis, as demonstrated in Act No. 23-02 of A25pril 2023, relating to the implementations of labor union rights. However, alongside to other regulations relating to the use of freedom of workers unionization, there exist obstacles to the practice of workers union freedom that undermine the legal assurances for the protection of liberty of union in public service.
