آليات تعزيز نزاهة الصفقات العمومية في ظل مستجدات القانون 23-12

Résumé: تعد الصفقات العمومية أهم مجال للإنفاق الحكومي لغرض تلبية الاحتياجات العمومية في إطار تحصيل الموارد وتسيير المرافق العامة وإنجاز الأشغال الكبرى وكل ما يتعلق بالمشاريع ذات الأهمية الوطنية التي تقع على عاتق الدولة، ولذات الأهمية تخضع إجراءات اختيار المتعاملين لمبدأ المنافسة وحرية الوصول للطلب العمومي وبإجراءات شفافة وواضحة يعززها ثباتا تشريعيا تُصْنَعُ في ظله المراكز القانوني للمتعاملين المتعاقدين، وقد جاء النص التشريعي الجديد ليكرس هذه المبادئ ويضفي ضمانات جديدة من خلال استحداث هيئة المجلس الوطني للصفقات العمومية، وإحداث البوابة الالكترونية لايداع ملفات العروض وتبادل المعلومات والبيانات ودراستها وومعالجتها إلكترونيا، وتعزيز آليات الرقابة المتنوعة على إبرام الصفقات العمومية وتنفيذها، إلا أن ذلك وحده لا يمكنه كبح زمام الفساد المستشري إلا بتشديد الجزاء وتوقيعه على كل من يثبت في حقه خرقا للقانون مهما كان مركزه القانوني. Public procurements are the core area of government expenditure to meet public requirements within the framework of resource collection, management of public utilities, completion of major works and everything linked to national-scale projects that fall under the responsibility of the state. Equally important, the procedures for selecting dealers are subject to the principle of competition and free access to public demand, with transparent and explicit procedures strengthened by the legislative stability that creates the legal positions of contracting parties. The new legislative text enshrines these principles and adds new guarantees through the establishment of the National Council for Public Procurements and the creation of an electronic portal for filing bid files, exchanging information and data, studying and processing them electronically, as well as strengthening the various control mechanisms over the conclusion and implementation of public procurements. However, this alone will not be enough to rein in rampant corruption until stricter penalties are enforced and imposed on anyone proven to have violated the law, regardless of his legal position.
