ممارسة حق الشفعة بعد التنازل عن حق الامتياز الفلاحي

Résumé: الشفعة تعتبر وسيلة من وسائل اكتساب الملكية العقارية والحقوق العينية العقارية الأخرى سواء من طرف أشخاص القانون العام، أو أشخاص القانون الخاص وفي هذه الحالة متى بيعت الرقبة أو حق الانتفاع أو حصة الشريك حسب الحالة، لذلك تعتبر قيد من القيود الواردة على سلطة التصرف في الأملاك العقارية، إذ القانون10/03 منح للمستثمر الفلاحي الحق في التنازل عن حق الامتياز في إطار هذا القانون ، ومن حق الدولة ممارسة حق الشفعة وبتالي تكون في هذه الحالة مكرسة لباقي أعضاء المستثمرة الفلاحية المنتمي إليها المتنازل أو الديوان الوطني للأراضي الفلاحية لفائدة الدولة باعتبارها مالكة الرقبة Pre-emption is one of the means of acquiring real estate ownership and other real property rights, whether by persons of public or private law. The Law 10/03 grants the agricultural investor the right to waive the concession right, and the state has the right to exercise the right of pre-emption, and therefore in this case it is designated to the rest of the members of the agricultural investor belonging to the assignee or the National Agricultural Land Office for the benefit of the state as theone who has the legal property.
