المركز القانوني للكفيل في عقد الكفالة التضامنية ( دراسة مقارنة )

Résumé: الأصل في الكفالة أنها لا تكون تضامنية، أي أن الكفيل لا يكون ملزماً بدين الكفالة إلا إذا لم يف به المدين نفسه، لذلك وجب على الدائن الرجوع أولاً على المدين الأصلي فإن عجز المدين عن الوفاء جاز للدائن الرجوع على الكفيل. ولكن يجوز بإتفاق المتعاقدين أو بنص القانون على جعل الكفالة تضامنية بين الكفيل والمدين وفي هذه الحالة يكون الكفيل ملزماً بالوفاء دون أن يستطيع دفع المطالبة إذا ما وجهت إليه أولاً من قبل الدائن بعدم جواز مطالبته قبل مطالبة المدين او دفع إجراءات التنفيذ على أمواله بحق التجريد أو طلب تقسيم المطالبة بينه وبين غيره من الكفلاء إن وجدوا. فالكفالة التضامنية جعلت الكفيل في مركز المدين الأصلي وهذا يعد خلافاً للأصل، وما يترتب على ذلك من آثار تكون أشد قسوة على الكفيل المتضامن من الكفيل العادي وهذا ماسنبينه من خلال هذه الدراسة . الكلمات المفتاحية: الكفالة، تضامنية، الكفيل، الوفاء. Abstract: The principle of the guarantee is that it is not solidarity, in other words, the guarantor is not bound by the debt of the guarantee unless the debtor himself does not fulfill it. As a reult, the creditor must first return to the original debtor, but if the debtor was unable to fulfill the debt, the creditor may return to the guarantor. However, with the agreement of the contracting parties or the text of the law, the guarantee between the guarantor and the debtor may be made solidarity. In such a case, the guarantor is obliged to fulfill the debt without being able to refuse the claim if it was first directed to him by the creditor, that it is not permissible to claim him before the debtor’s claim or payment of the execution procedures on his money for the right of dispossession or the request to divide the claim between him and other guarantors, if any, because the solidarity guarantee placed the guarantor in the position of the original debtor, and this is contrary to the original, and the consequences of that are more severe on the solidarity guarantor than the ordinary guarantor, and this is what the researcher will show through this study.
