حماية أجنة الأنابيب في الفقه الإسلامي والتشريع الجزائري

Résumé: ملخص: لقد أدى التطور الكبير في المجال الطبي إلى حل العديد من المشكلات خاصة تلك التي تتعلق بمشاكل الحمل، فظهر ما يعرف بالتلقيح الاصطناعي الخارجي أو ما يسمى بأجنة الأنابيب كوسيلة علاجية لبعض حالات العقم والعيوب التي قد تصيب أحد الزوجين أو كلاهما والتي تحول دون إنجابهما بالطريق المعهود ، وعلى الرغم من ايجابياته إلا أنه أثار العديد من الإشكالات خاصة في مدى اعتراف الفقه والقانون بحق الجنين في الحياة وهو خارج الرحم وضمان تلك الحياة له مثله مثل الجنين الطبيعي الذي تجرم كل الاعتداءات عليه سواء في الشريعة الإسلامية أو في القوانين الوضعية، ومن ثم كان لابد من معرفة مدى الحماية المكفولة له في الفقه الإسلامي والتشريع الجزائري وهو خارج الرحم، وهو محور الدراسة في بحثنا هذا . كلمات مفتاحية: الجنين.، التلقيح الاصطناعي.، الحماية القانونية.، الإجهاض.، أجنة الأنابيب. Abstract: The big development in the medical domain led to solving many problems especially those related to pregnancy issues especially the Invention of In-Vitro Fertilization ( IVF( to face sterility and the problems that many hinder the couple from having children conventionally, despite its advantages IVF has brought about many issues especially when it comes to the recognition of Islam and the legislation of the fetus’s for life outside the womb, and the insurance of life for him just like the normal fetus against whom all the violations are forbidden either in Sharia or the legislation, therefore we have to find out to the extent to which Islam and the Algerian legislation guarantee a protection for the fetus outside the womb; this is our focal point.
