حدود الوصاية الإدارية على الجماعات المحلية

Résumé: أخضع المشرع الجزائري الجماعات الإقليمية لرقابة إدارية تمارسها السلطات المركزية، متمثلة في الوالي كجهة وصاية على المجلس الشعبي البلدي، وزير الداخلية كجهة وصاية على المجلس الشعبي الولائي، وهذا حفاظا على وحدة الدولة من جهة وحماية لمبدأ المشروعية من جهة ثانية. غير أن جهات الوصاية مقيدة بالقانون في إطار لا وصاية إلا بنص قانوني، كما أنها خاضعة لرقابة القضاء الإداري المختص، إذا ما خالفت تصرفاتها القانون أثناء ممارستها لرقابة الوصاية على المجالس المحلية المنتخبة. The Algerian legislator subjected the regional groups to administrative control exercised by the central authorities, represented by the governor as a guardian of the Municipal People's Assembly, and the Minister of the Interior as guardianship of the State People's Assembly, and this is to preserve the unity of the state on the one hand and to protect the principle of legality on the other hand. However, guardianship bodies are restricted by law within the framework of no guardianship except by legal text, and they are also subject to the supervision of the competent administrative judiciary, if their actions violate the law while exercising guardianship control over the elected local councils.
