مناهج الاجتهاد في علمي الفقه والأصول

Résumé: الملخص: يعالج هذا المقال منهجين مهميين في البحث والاجتهاد في علمي الفقه والأصول وكيفية الاستفادة منهما في عملية الارتقاء بعملية البحث العلمي وتكوين الباحث، نقول أنه قد تباينت في هذا المجال مناهج الاجتهاد، بين منهج التقليد والمتمثل في التخريج الفقهي والأصولي، ومنهج التجديد. وهما طريقتين متكاملتين، فلا يمكن لمجدد في الفقه والأصول أن يرقى لهذه الرتبة دون أن يكون مجتهدا متمذهبا محصلا للمذهب فروعه وأصوله قادرا على استنباط الأحكام الشرعية وفق منهجية صاحب المذهب، وإلحاق النوازل الجديدة التي لا نص فيها بالأحكام المنصوصة، وقد دلّلنا على هذه الفكرة بمراحل الاجتهاد والطلب عند الإمام المجدّد أبي إسحاق الشاطبي والذي يعد أحد مجددي أصول الفقه المالكي. Abstract: - This article deals with two important methodes in research and ijtihad in jurisprudence and principles, and how we can benefit from them in the formation of the researcher and the advancement of scientific research. We say that the 'Ijtihad methods ' varied between the “tradition method”, that represented in the “jurisprudential altakhrij ” and the “renewal method ; They are two complementary methods. A renewed in jurisprudence and fundamentals cannot reach to this rank without being a mujtahid who knows the origins and branches of a certain doctrine of jurisprudence, and is able to derive jurisprudential rulings in the manner of the owner of the doctrine. We have proven this idea through the stages of diligence and demand among the regenerator Imam Abu Ishaq Al-Shatibi, who is considered one of the Innovative of the " alfuquh wal'usul"of The Maliki school of thought
