التأريخ الاجتماعي والاقتصادي للمرأة الجزائرية في العهد العثماني من خلال الوثائق القضائية بالمكتبة الوطنية وعينات من وثائق الأرشيف الوطني الجزائري

Résumé: لقد كشفت لنا مختلف الوثائق الارشيفية الخاصة بتاريخ الجزائر خلال العهد العثماني أن المرأة الجزائرية كان لها حضور فعال في تأريخ دورها الاجتماعي والاقتصادي للبلاد، وبروزها كعنصر اساسي في المجتمع يوثق عقوده المختلفة حفاظا على حقوقه تماما مثل الرجال وقد تنوعت هذه العقود بين ما يتعلق بشخصها وذاتها وحياتها الخاصة مثل عقود الزواج والطلاق، والميراث... ومنها ما يرتبط بأدوارها الاقتصادية والاجتماعية في علاقاتها بأسرتها أو بمجتمعها كعقود الهبات والتنازل عن حقوق مادية أو بيوع أو شراء أو مقبوضات لديون أو املاك توقفها... لقد كانت المرأة حاضرة في هذه العقود التي توثقها الادرة عن طريق قضاتها في محاضر رسمية مختومة بحضور شهود على حسب العقد عند التفكير في دراسة هذه العقود المتنوعة يتبادر الى الذهن مجموعة من الاسئلة بمثابة اشكاليات تستوجب البحث عن اجابات لها لكي توضع هذه الدراسة في قالب الدراسات الاجتماعية التي تخص المرأة الجزائرية خلال العهد العثماني وقد حددت لهذه الدراسة ثلاث اشكاليات رئيسية 1- هل حفظت المرأة حقوقها من خلال تلك العقود وتمتعت بحماية السلطة أثناء تطبيق تلك العقود؟ 2- كيف استطاعت المرأة ان يكون لها دور اجتماعي واقتصادي في البلاد خلال تلك الفترة؟ 3- هل كانت المرأة حرة في أدوارها المختلفة الاقتصادية والاجتماعية من خلال عقود الزواج والوقف والهبة؟ من خلال مجموعة من الوثائق القضائية المتواجدة بالمكتبة الوطنية وعينات من عقود المحاكم الشرعية المتواجدة بالأرشيف الوطني اتضح أن المرأة كانت حريصة على توثيق كل عقودها وحرصها على حماية حقوقها من الضياع ولقد حرصت السلطة على حماية هذه الحقوق بتوثيقها من طرف قضاة تستمد شرعيتها من الشريعة الاسلامية الشيء الذي جعل لهذه العقود الصبغة الدينية يحرم عدم الالتزام بها او الاخلال بها. Various archival documents on the history of Algeria during the Ottoman era have revealed to us that Algerian women had an effective presence in the history of their social and economic role in the country, and their emergence as an essential element in society documenting its various contracts in order to preserve its rights, just like men. These contracts varied between what related to their person, themselves, and their private lives, such as Marriage, divorce, and inheritance contracts...Some of them are related to her economic and social roles in her relationships with her family or community, such as gift contracts, the transfer of material rights, sales or purchases, or receipts for debts or property that she stops ... Women were present at the contracts, which were documented by the administration through its judges in official records sealed in the presence of witnesses according to the contract. When thinking about studying these various decades, a set of questions come to mind as problems that require searching for answers in order to place this study in the template of social studies related to Algerian women during the Ottoman era. Three main problems have been identified for this study: 1- Did women preserve their rights through those contracts and enjoy the protection of the authority during the implementation of those contracts? 2- How were women able to have a social and economic role in the country during that period? 3- Were women free in their various economic and social roles through marriage contracts, endowments, and gifts? Through a collection of judicial documents in the National Library and samples of Sharia court contracts in the National Archives, it is clear that women were keen to document all their contracts and were keen to protect their rights from loss.The authority was keen to protect these rights by documenting them by judges who derived their legitimacy from Islamic law, which made These contracts have a religious character, and it is forbidden not to abide by them or violate them.
